1. Acceptance of these terms
These Terms of Use (“Terms”) govern your access to and use of optimus-ordergen3.info (the “Site”), operated by Optimus Gen 3 (“we”, “us”). By using the Site or submitting a reservation, you agree to these Terms. If you do not agree, please do not use the Site.
Reservations are also subject to our Reservation & Refund Policy, and our handling of personal data is described in our Privacy Policy.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to submit a reservation. If you reserve on behalf of an organisation, you confirm that you are authorised to act for it.
3. Nature of the Site and product information
The Site presents information about the Optimus Gen 3 humanoid robot, which is in pre-production. Specifications, images, capabilities, delivery windows and edition contents are targets and illustrations and may change before delivery. Photographs may show prototypes, test environments or representative scenes rather than final production units.
Nothing on the Site is an offer capable of acceptance. A binding sale only arises under a separate written order agreement that you sign after your site review.
4. Reservations
- Submitting the reservation form is free and does not create an obligation for you to buy or for us to sell.
- We may decline or cancel a reservation, for example if the delivery country is unsupported, the information appears inaccurate, or we detect abusive or automated submissions.
- Reservations are personal to you or your organisation and may not be sold or transferred without our written consent.
- Queue positions and delivery estimates are indicative and may change.
5. Acceptable use
You agree not to:
- use the Site in a way that breaks any law or infringes anyone’s rights;
- submit false, misleading or third-party information without authorisation;
- attempt to gain unauthorised access to the Site, its servers or related systems;
- introduce malware or interfere with the Site’s operation or security;
- scrape, harvest or bulk-extract content or data by automated means without our permission;
- reproduce the Site’s design or content to impersonate us or mislead others.
6. Intellectual property
The Site and its content — including text, graphics, drawings, logos, product names and code — are owned by or licensed to us and protected by intellectual property laws. You may view and print pages for personal, non-commercial reference. Any other use requires our prior written permission. Certain photographs are used under licence from their respective creators.
7. Feedback
If you send us ideas or suggestions about our products, you grant us a non-exclusive, royalty-free, worldwide licence to use them without obligation to you.
8. Third-party links and services
The Site may link to or load resources from third parties (for example, font and script delivery networks). We are not responsible for third-party content or practices, and your use of them may be subject to their own terms.
9. Disclaimers
The Site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including fitness for a particular purpose, accuracy and non-infringement. Warranties for delivered robots are set out solely in the order agreement and product warranty documentation.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data or goodwill, arising from your use of the Site or a reservation. Our total liability relating to the Site and reservations is limited to one hundred euros (EUR 100).
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.
11. Indemnity
If you use the Site for business purposes, you agree to indemnify us against claims arising from your breach of these Terms or misuse of the Site, to the extent permitted by law.
12. Changes and availability
We may change, suspend or discontinue any part of the Site at any time. We may update these Terms; the updated version applies from the “Last updated” date. Material changes affecting active reservations will be notified by email.
13. Governing law and disputes
These Terms are governed by the laws applicable at the operator’s place of establishment, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts. Before starting proceedings, we encourage you to contact us so we can try to resolve the issue informally. EU consumers may also use the European Commission’s online dispute resolution platform.
